1. Validity of the Purchase Terms

By making a purchase, you confirm that you have read and agree to the Purchase Terms and Privacy Policy. The terms apply between users (hereinafter referred to as Buyer) and the online store owner Smx.ee, Smx Trade OÜ (registration code: 11613214), located at Jaaniku tee 1-11 Harkujärve, Harjumaa (hereinafter referred to as Online Store).

In addition to these terms, the legal relationships arising from the purchase of products from the online store are regulated by the Law of Obligations Act of the Republic of Estonia (hereinafter LPA), the Consumer Protection Act (hereinafter CPA), and other legal acts. The Online Store reserves the right to make changes to the sales terms. These changes will be reflected under the terms on the online store.

2. Price Information

All prices listed in the Online Store include VAT 22%.

Additional fees, including transportation costs or administrative fees, may be added to the price of the goods listed in the Online Store as stipulated in the Purchase Terms. The amount of additional fees depends on the value of the Customer's shopping cart and the delivery method chosen by the Customer. Costs added to the prices of purchased products are calculated and specified in your shopping cart when placing an order.

The Online Store reserves the right to make changes to the sales prices. These changes will be reflected on the website.

3. Placing an Order

Select suitable products. Add the desired products to the shopping cart.

To place an order, first click on the "Place Order" link in the shopping cart.

On the order placement page, fill in the required fields, select the delivery method and payment method that suits you, and click the "Confirm Order" link.

By choosing the payment method "Bank Link", you can conveniently pay through a bank link (Swedbank, SEB). The order, along with payment information, will also be sent to your email.

Carefully fill in the fields on the data and order confirmation page, as the accuracy and correctness of the submitted information will ensure the quick and problem-free delivery of your purchased products, as well as the resolution of any later disputes and claims.

Orders placed in the Online Store are processed on business days (Mon-Fri 9.00-17.00). If the order is placed on Friday after 14:00, it will be processed the following Monday. This also applies to the "pickup in person" delivery option. Please be sure to call the e-store contact number in advance if you are picking up in person.

4. Conclusion of the Sales Contract

The sales contract is concluded after the order is confirmed.

Under the sales contract, the Online Store undertakes to transfer the purchased Goods to the Buyer and make it possible for the ownership to be transferred to the Buyer, and the Buyer undertakes to pay the amount indicated on the invoice presented for the Goods and to accept the Goods.

Orders that are not paid for will be canceled after 3 days from the order placement date.

5. Delivery

After the sales contract is concluded, the Online Store compiles the order and hands it over to the logistics partners for delivery. Delivery of goods in stock usually takes place within 1-3 business days. If the goods are not in stock and need to be ordered, the average delivery time is 2-4 weeks. The exact delivery time is indicated for each product.

The delivery deadlines stated in the Online Store apply from the moment the order amount is received.

For timely delivery, the Buyer must provide accurate and valid data when entering delivery information. If inaccurate delivery data is provided or if the parcel is not picked up from the parcel machine, the additional delivery cost is borne by the Buyer.

The Online Store is not responsible for delays in the delivery of goods due to delays by the logistics partner or delays caused by force majeure (natural disaster, war situation).

If it is not possible to deliver the ordered goods due to the unexpected end of stock, the Online Store will notify the Buyer and refund the paid money (including the cost of handing over the goods) immediately, but no later than within 14 days.

6. Returns

After receiving the order, the Buyer has the right to withdraw from the contract concluded in the online store within 14 days. You can find the standard withdrawal form here - Goods Return.

The undamaged goods to be returned must be intact and in good technical condition. The Buyer is only responsible for the decrease in the value of the goods due to their use, if the Buyer has significantly damaged the condition of the goods and the selling value of the goods has consequently decreased.

To return the goods, a withdrawal form must be submitted, which can be found here - Goods Return or sent to the e-store contact email within 14 days of receiving the goods.

The Online Store will refund the purchase amount along with the delivery costs to the Buyer immediately upon receiving the withdrawal form and the returned goods, but no later than within 14 days. The delivery cost is not refunded to the Buyer if the returned goods are not defective and comply with the product description; in this case, the cost associated with the withdrawal is borne by the Buyer.

Purchased goods cannot be returned if the ordered product is manufactured considering the personal needs of the buyer or according to the buyer's terms and as a custom order. Goods cannot be returned if it contradicts health protection or hygiene requirements, such as opened packaged underwear and perishable goods. Opened packaged computer software and audio-video recordings cannot be returned either.

8. Force Majeure

The Online Store is not responsible for damages caused to the Buyer or delays in the delivery of goods if the delay or damage is due to circumstances that the Online Store could not influence or foresee (natural disaster, war situation, etc.).

9. Processing of Personal Data

By entering data in the online store and confirming accordingly, the Buyer gives the right to collect and process the Buyer's personal data (name, contact phone, delivery address and/or home address, email address) and forward them to the logistics partner for the delivery of goods.

The Buyer has the right to choose whether to receive e-store newsletters and other information to the contact details left in the Online Store.

The Buyer has the right to prohibit the collection and use of their personal data at any time, except when it is necessary to fulfill a claim arising from the contract or for the delivery of goods.

The Buyer has the right to require the deletion of their personal data and account from the e-store environment.

10. Warranty and Claims Procedure

The product carries a manufacturer's warranty if it is specified in the product description or the documents accompanying the product. The warranty is valid according to the manufacturer's warranty conditions, which can vary depending on different manufacturers. The absence of a warranty does not eliminate the Buyer's right to file claims.

The Buyer has the right to file a claim within 2 years after purchasing the goods.

The Online Store is responsible for the non-compliance of the goods sold to the Buyer with the terms of the contract or defects that occur within two years from the date of handing over the goods to the Buyer.

The Buyer has the right to contact the Online Store within two months upon discovering a defect by presenting the sales invoice, contract, or another document proving the purchase.

In the event of detecting a defect in the goods, please contact the Online Store immediately and stop using the goods.

The repair or replacement of defective goods will be agreed upon between the Online Store and the Buyer.

The Online Store is not responsible for defects caused to the product due to intentional damage or improper use committed by the Buyer.

In the event of non-compliance of the product with the standards or presence of defects, please send the relevant information to the e-store email, including the orderer's name, contact phone, order number, and a precise description of the non-compliance or defect.

A claim regarding non-compliance or defect of the product must be filed no later than two months from the discovery of the non-compliance or defect.

All submitted claims will be reviewed as soon as possible but no later than within 14 days of receiving the claim.
